1 ACCEPTANCE OF TERMS (www.thepmi.com)

1.1 Your access to and use of the PMI web site, (“the web site”) is subject exclusively to these Terms and Conditions. You will not use the Web site or services offered by the web site for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the web site or services offered by the web site you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the web site.

1.2 We reserve the right to update or amend these Terms and Conditions at any time and your continued use of the web site or services offered by the web site following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.

2 USER ACCOUNT, PASSWORD AND SECURITY

4 TERMINATION

4.1 We have the right to terminate your access to any or all of the service at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. We may also at any time, at our sole discretion, discontinue the web site or services offered by the web site or any part thereof without prior notice and you agree that we shall not be liable to you or any third party for any termination of your access to the web site.

5.1 The web site or services offered by the web site may include links to third party web sites that are controlled and maintained by others. Any link to other web sites is not an endorsement of such web sites and you acknowledge and agree that the PMI web site is not responsible for the content or availability of any such sites.

6.1 The web site and its content (including without limitation the web site design, text, graphics and all software and source codes connected with the web site and the service) are protected by copyright, trade marks, patents and other intellectual property rights and laws.

7.1 You agree to indemnify and hold the PMI web site harmless from and against any breach by you of these Terms and Conditions and any claim or demand brought against the PMI web site by any third party arising out of your use of the web site.

8 DISCLAIMERS AND LIMITATION OF LIABILITY

8.1 Use of the web site or services offered by the web site is at your own risk. The web site or services offered by the web site are provided on an “AS IS” and “AS AVAILABLE” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

8.2 To the extent permitted by law, the PMI web site will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the web site.

9 SEVERANCE

9.1 If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

10 GOVERNING LAW

10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and you hereby submit to the exclusive jurisdiction of the Irish courts.

11 E-COMMERCE PAYMENTS

11.1 If, through the web site, you make electronic payments relating to membership subscription and/or event participation we will gather such information as may reasonably be required to complete the transaction, including your name, e-mail address, contact telephone number, credit card type, full name as displayed on the credit card, credit card number and expiry date.

The PMI may use the personal and payment information provided by you for its own internal business purposes. Also, in order to provide the e-commerce service, it may be necessary that The PMI forwards certain personal and payment information provided by you to third party banking and credit institution.

11.2 From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend the PMI and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client’s exercise of Internet electronic commerce.

11.3 Refund Policy: Payments made through use of the website, relating to membership subscription and/or event participation, are non-refundable.

12 Data Protection and Privacy Statement

12.1 The PMI respects your right to privacy. Visitors should be aware that each time they visit a website two general levels of information about their visit can be retained. The first level comprises statistical and other analytical information collected on an aggregate and non-individual specific basis of all browsers who visit the site, and the second is information that is personal or particular to a specific visitor who knowingly chooses to provide that information. The PMI’s policy is to respect and protect the privacy of our Customers and will never wilfully disclose individually identifiable information about its Customers to any third party without first receiving that Customer’s permission.

12.2 The statistical and analytical information provides us with general and not individually specific information about the number of people who visit this website; the number of people who return to this site; the pages that they visit; where they were before they came to this site and the page in the site at which they exited. This information helps us monitor traffic on our website so that we can manage the site’s capacity and efficiency.
